Welcome to InThePaintShots. By booking a photography session, purchasing photographs, or downloading images from our website or online galleries, you agree to the following Terms of Service.
1. Services
In The Paint Shots provides sports photography services, including event coverage, individual athlete photography, digital image downloads, prints, recruiting images, and related products.
2. Ordering and Payment
Payment is required before digital downloads, prints, or other products are delivered unless otherwise agreed in writing.
Accepted payment methods may include major credit cards and other payment options offered through our online store.
Prices are subject to change without prior notice. Price changes do not affect orders that have already been placed and paid.
3. Digital Downloads
Purchased digital downloads include a non-exclusive, non-transferable license for personal use only.
Personal use includes:
Sharing on personal social media accounts.
Printing for personal display.
Providing images to schools or college coaches for recruiting purposes.
Creating personal keepsakes.
You may not:
Sell the images.
License the images to another person or business.
Use the images for advertising or commercial purposes.
Alter or remove watermarks from preview images.
Claim ownership or authorship of the photographs.
4. Copyright
All photographs remain the exclusive copyrighted property of InThePaintShots.
Purchasing a photograph does not transfer copyright ownership.
5. Image Delivery
Digital images are delivered through an online gallery after payment has been successfully processed.
While we strive for prompt delivery, delivery times may vary based on event size and editing workload.
7. Refunds
Due to the nature of digital products, all digital download sales are final.
Print orders may be replaced if they arrive damaged or contain a printing defect. Claims must be submitted within 7 days of delivery and include photographs of the damage.
8. Cancellations
Photography session cancellations made at least 48 hours before the scheduled session may be rescheduled without penalty.
Deposits, if applicable, are non-refundable unless otherwise stated.
9. Weather and Event Changes
Outdoor sessions or sporting events affected by weather, venue closures, or event cancellations may be rescheduled when possible.
In The Paint Shots is not responsible for cancellations beyond our control.
10. Limitation of Liability
If circumstances beyond our reasonable control prevent image delivery, our liability is limited to the amount paid for the affected order.
We are not responsible for missed images due to athlete participation, game circumstances, venue restrictions, or other events outside our control.
11. Privacy
Customer information is used solely for processing orders, communicating with customers, and improving our services.
We do not sell personal information to third parties.
12. Gallery Availability
Online galleries may remain available for a limited period. Customers are encouraged to download purchased images promptly.
In The Paint Shots is not responsible for maintaining permanent online storage of purchased galleries.
13. Recruiting Use
Athletes and families are encouraged to use purchased photographs for recruiting profiles, college communications, highlight materials, and personal branding.
14. Governing Law
These Terms of Service shall be governed by the laws of the State of Illinois, without regard to its conflict of law principles.
